Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Prior to the accident which occurred on or about 2/1/96 at the East side of landfill at unit 3 working face- employee working as a spotter was not provided with bright, reflective clothing nor wearing a dull mesh traffic vest provided! necessary for the operator of the Rex Trashmaster 3-90C compactor to see him while operating the moving equipment, thereby exposing the employee to a fatal crushing injury. A feasable and useful means of abatement includes, but is not limited to the following actions: 1. Reinstitute a means of communication between the spotter and the equipment operator to ascertain the position of the spotter i.e. radio!. 2. Provide reflective or high-visibility clothing beyond the traffic safety vest provided so spotter can be easily seen. 3. Train employees to recognize the importance of wearing high-visibility clothing and enforce company safety rules that require employees to wear such clothing, and to respond in a timely manner to employees concerns about recognized hazards. 4. Install mirrors on compactors and other equipment to minimize blind spots.
