Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of falling masses of unstable wood chips, 15-20 feet in height from floor level, while in the process of dislodging (punching wood clumps of wood chips which had built-up around the drag conveyor in the fuel storage bin on or about 11/19/85. Among other methods, one feasible and acceptable method to correct this hazard is to prohibit employees from entering the fuel storage bin or to empty the bin of wood chips before personnel entry.
