29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a) On or about March 20, 2017, the employer did not ensure that daily inspections of excavations and adjacent areas were made by a competent person for evidence of a situation that could result in cave-ins. Employees were exposed to cave-in hazards in that employees entered an excavation 18 feet deep where there was evidence of undermined walls, sloughing off of soil, stress cracks near the edge of the excavation, all of which are evidence of possible cave-ins. Excavation was not inspected daily by a competent person. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
