29 CFR 1910.1018(n)(1)(i)(B): A medical surveillance program was not instituted for all employees who had been exposed to inorganic arsenic above the action level, without regard to the use of respirators, for 30 days or more per year for a total of 10 years or more of combined exposure with the employer or predecessor employers: (Construction Reference: 1926.1118) On or about March 20th 2017, at the site located at 347 Don Shula Dr. Miami Gardens, FL 33056, the employer did not institute a medical surveillance program for all employees who had been exposed to inorganic arsenic for more than 30 days and above the Action Level of 5 µg/m3.
