Text For Citation: 01 Item/Group: 001A Hazard:
29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly: a. On or before February 16, 2017, the employer did not ensure that the job made platform attached to the Caterpillar forklift (model: EX5000; S/N: A4EC320327) had the manufacturer's written approval for use such as lifting employees, thereby exposing employees to a fall hazard. An employee injury occurred on or about February 9, 2017, when the unapproved platform attached to the forks of the Caterpillar forklift broke and fell over causing the employee and platform to fall approximately 3.5 to 4 feet to the concrete floor below.
