29 CFR 1910.1020(e)(2)(i)(A)(3): Exposure records to the extent necessary to reasonably indicate the amount and nature of the toxic substances or harmful physical agents at workplaces or under working conditions to which the employee is being assigned or transferred were not being maintained: The employer is failing to maintain exposure record(s) of employee monitoring and exposure to hydrogen sulfide. This was most recently documented on February 7, 2017 at the Wyss Tank Battery located on the South East corner of the intersection of 3rd Avenue and Road 357, South West of Trenton Nebraska. The employer is failing to maintain records related to exposure in the following but not limited to: a) Employees are provided single gas direct reading instruments to alert employees to potentially life-threatening atmospheres and/or document employee exposure to hydrogen sulfide. The employer does not maintain these exposure records for employees. b) Employees are not provided gas direct reading instruments to alert employees to potentially life-threatening atmospheres and/or to document employee exposures to acute hydrocarbons or oxygen deficient atmospheres.
