29 CFR 1926.451(g)(1): Each employee on a scaffold 10 feet above a lower level was not protected from falling to the lower level: (a)Hultgren Construction, LLC at 132-136 S. Phillips Ave., Sioux Falls, SD 57104: On or about and at times prior to December 2, 2016, the controlling and exposing employer did not ensure that employees were protected from a fall from elevation, in that guardrails or other suitable fall protection were not properly installed on the working platform of the scaffolding. The scaffold system used on the roof of Skelly's south lacked top rail. This condition exposed employees to a fall of approximately 18 feet. (b)Hultgren Construction, LLC at 132-136 S. Phillips Ave., Sioux Falls, SD 57104: On or about and at times prior to December 2, 2016 , the controlling and exposing employer did not ensure that employees were protected from a fall from elevation, in that guardrails or other suitable fall protection were not properly installed on the working platform of the scaffolding. The narrow width scaffold system used within Skelly's south and the Copper Lounge lacked guardrails. This condition exposed employees to a fall of approximately 12 feet.
