29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazards in the workplace: (a)Hultgren Construction, LLC at 132-136 S. Phillips Ave., Sioux Falls, SD 57104: On or about and at times prior to December 2, 2016 the employer did not identify and evaluate the respiratory hazards in the workplace. Employees and temporary employees performed demolition activities that involved the removal of brick walls with sledge hammers and a hammer drill. The demolition process generated dust and respirable silica. This condition exposed employees to respiratory hazards including silica, asbestos, acids, and welding fumes. Abatement Note: The requirements applicable to construction work under 29 CFR 1926.103 are identical to those set forth at 29 CFR 1910.134 of this chapter.
