Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) On or about September 29th, 2016 for an employee who suffered fatal injuries while covering a silage pile with tarps at 48514 U.S. Highway 14, in Elkton, South Dakota. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct the hazard would be to implement a policy where a signal person is used in accordance with the manufacturers operator manual for the 344J John Deere front end loader (page 19 of the Safety Operating Procedures): Use a signal person when backing if view is obstructed or when in close quarters. Keep signal person in view at all times. Use prearranged hand signals to communicate.
