Text For Citation: 01 Item/Group: 003A Hazard:
29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a) On or about August 10, 2016, an employee was exposed to cave-in hazards while working in a 6.3 feet deep trench. The competent person did not perform any type of manual test to properly determine the soil type and did not conduct adequate inspections to address hazardous conditions prior to allowing employees to work in the trench. Also, a 20 feet metal pipe was located near the edge of trench that was placed on the fork of the forklift. The forklift was parked on an angled position and putting the metal pipe on an uneven position. NCB, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 977817, citation number 3, item number 1 and was affirmed as a final order on August 11, 2014, with respect to a workplace located at 1936 Liggett Rd., Castle Rock, CO 80109.
