29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) At the sawmill, on or about August 17, 2016, a hearing conservation program was not implemented for an employee who was exposed to noise at 214.1% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 95.4 dBA during the 379 minute sampling period, resulting in a noise hazard. b) At the sawmill, on or about August 17, 2016, a hearing conservation program was not implemented for an employee who was exposed to noise at 444.5% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 100.7 dBA during the 377 minute sampling period, resulting in a noise hazard. c) At the sawmill, on or about August 17, 2016, a hearing conservation program was not implemented for an employee who was exposed to noise at 322.9 % of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 98.4 dBA during the 377 minute sampling period, resulting in a noise hazard. d) At the sawmill, on or about August 17, 2016, a hearing conservation program was not implemented for an employee who was exposed to noise at 388.5% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 99.7 dBA during the 378 minute sampling period, resulting in a noise hazard.
