5(a)(1) a.Bilco Construction Pile Driving Operation - Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to a piece of pile driving equipment (a Foster hairpin which weighed between 2,000 and 2,500 pounds) suspended above his head while working from stirrups attached to the sheet piling approximately 10 feet above the ground. "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO KEEP ALL LOADS FROM ABOVE WORKERS HEADS AT ALL TIMES.
