29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment that were outside acceptable limits (defined by the process safety information on paragraph (d) of this section) in a safe and timely manner when necessary means where taken to assure safe operation. On June 7, 2016 and at times prior thereto at the Tyson Foods facility in Hope, Arkansas, the employer operated equipment in the refrigeration systems with deficient condition when: a) ammonia piping with deteriorated coatings and extensive corrosion damage was allowed to remain in service in the Second Processing system. b) ammonia piping in the 2nd Processing system is supported with electrical wire c) Ammonia piping in the First Processing system has deteriorated coatings and corrosion damage.
