Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a. Employees were exposed to multiple traumatic injuries, extensive burns and death from fire and/or explosion on/or before September 26, 1991. The employer did not determine that the chemical plant processing equipment, piping and associated safety devices met acceptable safe engineering designs and specifications. -and- The employer did not develop and implement safe operating pro- cedures for the FM-1- FA-1 chemical process inclusive with the flammable and combustible storage tank cleaning procedures. "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT-EACH OF THE TWO CONDITIONS ARE: "SAFE ENGINEERING DESIGNS AND SPECIFICATIONS" (a) Develop process equipment piping and instrumentation diagrams (P&ID'S) to ensure that all safety features are applies to the equipment and system(s) as follows: 1. construction 2. material(s) 3. electrical 4. sources of ignition 5. pressure relief system(s) 6. normal and emergency venting 7. bonding and grounding 8. normal and emergency procedure(s) -and- "DEVELOP AND IMPLEMENT SAFE OPERATING PROCEDURES FOR THE FM-1 AND FA-1 CHEMICAL PROCESS" (a) Develop and institute written standard operating procedures for the FM-1 and FA-1 process relating to reactor(s) 3 and 4 (to include normal and abnormal procedures). (b) Develop and institute standard operating procedures for the cleaning process of flammable/combustible liquid storage tanks. (c) Conduct training for all operators and mechanics on: 1. process design system(s) and P & ID(s) 2. process standard operating procedure(s).
