Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and crushing hazards: a) On or about 2/6/2016, Working face of landfill: An employee was struck and killed while operating and maintaining a Phelps portable trailer tipper. The employer failed to implement a system to prevent trucks from backing onto the tipper when the tipper operator is outside the tipper control cab and on the tipper deck. Among other feasible and acceptable means of abatement would be to: a) Ensure communication between tipper operators and truck drivers. b) Ensure that tipper operators are protected from any vehicular traffic. c) Ensure that truck drivers are provided a visual warning when the tipper operator is not inside of the tipper booth, such as the optional lighting package available form the tipper manufacturer. Abatement documentation is required for this item.
