29 CFR 1910.215(b)(9): The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch. On or about 29 January 2016, and at times prior thereto, a Milwaukee Bench Grinder modified as a pedestal grinder within the Maintenance Shop did not have the tongue guard adjusted to within one fourth inch from the surface of the abrasive wheel, exposing workers using the grinder to the hazard of being struck by flying pieces of the wheel and debris.
