OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to struck by hazards. On or about 13 January 2016, and at times prior thereto, damaged warehouse pallet rack systems were accessed and utilized to store materials weighing up to approximately 3,000 pounds per shelf overhead, exposing employees to the hazard of being struck by the falling racks and materials.
