OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from being struck by materials and equipment while installing a storm drainage system. On or about 18 November 2015, and at times prior thereto, four laborers were installing sections of a new storm drainage system while under a Volvo Excavator EC210CL bucket being used to move reinforced concrete pipe (RCP), exposing the employees to the hazard of being struck by materials and equipment.
