Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Possible crushing, entrapment and death from the hazards associated with the inadvertent, unexpected movement of the conveyor (transfer car). If the car at the number 94 furnace was not pulled all the way out the car would drift back into the furnace, closing and sealing the opening. Among other methods one feasible and acceptable method to correct this hazard is to provide the transfer car with self setting brakes, wheel chocks, bars or other positive devices to prevent the car from inadvertent movement and/or drift and to establish and maintain a maintenance program to ensure that the conveyor is maintained a condition that does not constitute a hazard (required by A.N.S.I. B20. 1-1990, para. 5.2(b)).
