Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Location - Grocery area: On or about 9/24/01, an employee was driving a Yale fork lift which the manufacturer had provided with seat belts, without wearing the protective restraint device (seat belt) that had been provided by the manufacturer. (b) Location - Grocery area: On or about 9/24/01, an employee was driving a Yale fork lift equipped with seat belts, and was not wearing the protective restraint device provided (seat belts). Among other methods, one feasible and acceptable abatement method to correct the violation is to require employees to use seat belts in fork lifts that are provided with them.
