Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that were exposed to the hazard of falling from defective ladders: FACILITY: The fiberglass ladder that had defective parts such as (but not limited to) broken support angles and spreader bars which were difficult to open and lock in place; the ladder was not removed from service. On or about 2/13/2008 a worker was standing on a 6-foot stepladder, when the ladder buckled underneath him causing him to fall to the floor below. The workers sustained hand injuries in the incident. Among other methods, one feasible and acceptable method to correct this hazard would be to: 1. Preform inspections and maintenance on ladders based on the manufacturer's recommendations. 2. Provide training to employees to remove damaged ladders from service until they are either repaired or destroyed.
