Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught in/crushing hazards or death: WORKPLACE: Employees were exposed to the rotating horizontal shaft coupler (power take- off) while getting on and off the seat from the rear of the International Harvester Farmall "Super M" tractor. On or about February 5, 2007, an employee slipped and fell off the tractor while trying to access the seat and the employee's right arm became entangled in the rotating power take-off coupler. The employee sustained an amputation of the right arm from the incident. Among other methods, one feasible and acceptable method to correct the hazard is to: 1. Guard the portion of the PTO that was unguarded. 2. Provide proper and safe means to access/egress the tractor seat. 3.Instruct and train employees in the proper and safe operation of the equipment. 4. Place safety signs/warning labels on locations recommended by the manufacturer. 5.Utilize other available engineering feasibility, technology and methods.
