Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Rail road track area between the Mold Shop on the southeast, the warehouse on the west side, and the mobile maintenance shop on the northeast side, where the distance between the two buildings on the south side was approximately 15 ft (4.55 m), where employees were allowed to use this area as a walkway. Employees were allowed to operate the fork truck(s) across the railroad tracks at the north end of the facility between the west warehouse and the northeast warehouse. Among other methods, two feasible and acceptable methods is to prohibit employees to use this approximately 15 ft. wide tunnel like area as a walk way and prohibit employees to operate the fork truck across the rail road tracks when trains are approaching.
