Text For Citation: 01 Item/Group: 001 Hazard: BURNS
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee sin that employees were exposed to: Overfill protection for above ground gasoline tanks was not provided. An employee was delivering gasoline to a pair of above ground tanks at a convenience store when an explosion and ensuing fire occurred. The employee was severely burnt and later died, approximately midnight November 5, 1993. The fuel for the explosion was provided by overfilling of the tank.
