29 CFR 1910.212(a)(1): Adams Thermal Systems does not provide machine guarding of the Matrix Core Machine to protect employees from hazards such as those created by point-of-operation, ingoing nip points, and rotating parts during normal production operations: (a) On November 7, 2011, an Adams Thermal System employee was exposed to crushing hazards and suffered a fatal injury when he was caught between the Core Press and the Header Press while adjusting a radiator core in production inside the Matrix Core Machine at the Adams Thermal Systems plant in Canton, SD. (b) At times on or before November 7, 2011, Adams Thermal Systems employees were exposed to hazards in the area of the Core Press Anvil, the Core Tilt Table, the Tube Shuttle, the Core Press, the Header Press, the Motoman Robot, the Comb/Tube Shelf, and the False Tube while performing production work such as feeding stock into the machine and adjusting radiator cores in production. To abate this violation, the employer must provide guarding to ensure that employees are not exposed to hazards such as those created by point-of-operation, ingoing nip points, and rotating parts.
