COPY TO : ABILENE AERO, INC. %% ATTN: Mr. Joe Crawford, President Municipal Abilene, TX 79601 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that new employees were not adequately supervised during the refueling of gasoline tank trucks: a) An employee engaged in refilling a gasoline tanker truck was not supervised sufficiently to prevent him from bypassing a safety switch and standing on the side of the truck. This placed an open hatchway, containing 5,000 to 12,000 ppm octane vapor, in his breathing zone. He was overcome by the vapors and drowned in liquid fuel overflowing from the hatchway. The employer did not act to ensure that this and other employees were obeying safety rules which would have prevented this fatality.
