Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazard of being crushed between the swivel and well head while working on a piece of hydraulic equipment on or about April 16, 1992, at West Gas, Inc., near Rapelje, Montana where an employee was working beneath the swivel and the draw works break was not secured by a chain and the break handle latching device spring was broken. Among other methods, feasible and acceptable abatement methods to correct this hazard are: (a) Do not work under a suspended load. (b) Attach the chain that was provided which would prevent the brake handle from disengaging. (c) Replace the broken spring on the brake handle latching device.
