Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about May 23, 1994, and possibly at times prior to that date, employees were exposed to the potential for serious crushing injuries while loading and securing row crop spraying equipment. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to ensure that those sprayers not equipped with stands or pivot lock weldments are properly blocked, chained, or in some other manner secured, prior to disconnecting from a tractor or other mode of transportation, to prevent the sprayer from pivoting forward. Secondly, ensure all employees are adequately trained in the proper procedures to follow when loading and securing farm implements and row crop sprayers onto trailers or other modes of transportation.
