Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about August 18, 1994, and at times prior to that date, employees transferring corrosive solutions through a pipeline system were exposed to the hazard of chemical burns caused by contact with hydrochloric acid solution released from a structurally failed pipeline system. Feasible methods of abatement would include, but not be limited to, the following: 1) Implement a pipeline system designed to withstand operational stresses. 2) Alter acid transfer procedure to minimize stress on the pipeline system. 3) Implement mechanical integrity program to ensure that equipment can withstand the operating conditions safely.ons
