Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Hazard of being thrown from work platform located on back of equipment used on May 20, 1992, to spray a power line right-to-way in that equipment having an obstructed view to the rear was backed on a steep hill and employer did not have an observer stationed on the ground where he was visible to the driver signaling it was safe to operate the vehicle in reverse. ABATEMENT: Among other methods, one feasible and acceptable method to correct this hazard is to back equipment only when absolutely necessary, plan where equipment is to stop and back only when an observer signals that it is safe to do so.
