Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a structural member of a sub-structure of an oil rig, being erected, was not secured in place with a safety pin. On or about February 7, 1993, at a site located three miles East of Evergreen, Alabama, off of State Highway 84E, the usbstructure portion of a derrick was being erected. Prior to the operations in progress, a safety pin or keeper had not been installed in a pain used to support an I-beam which, in turn, supported an A-leg member to Dislodgement of the pin subsequently resulted in allowing the A-leg member to fall. Among other methods, one feasible and acceptable abatement method would be to follow the erection an dinspectin procedures outlined in the operation and maintenance manual, and drawings for C-series Masts as provided by the manufacturer, Continental Emsco, which gives guidance on the erection drawings to install safety pins in all drive pins. The manual also recommends the use of checklists to identify missing safety pins.
