Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: %% (a) On or about 06/01/92 employee(s) were exposed to the hazard of falls while getting off a boatswains chair onto a fixed ladder appproximately 80 feet from the base of the water tower. Among other methods one feasible and acceptable abatement method to correct this hazard is to utilize two lanyards such that one lanyard would be attached to the load block (in lieu of a life line), the other lanyard would be used to connect to the fixed ladder prior to disconnecting the lantard connected to the load block. This will provide fall protection to the employee when getting off the boatswain chair onto the fixed ladder. (Reference 29CFR 1926.451(1)(4).) %% "IN THE ALTERNATIVE" %% 29CFR 1976.431(1)(4): An employee using a boatswain's chair was not protected by a safety belt and lifeline attached to the structure. %% (a) On or about June 2, 1992, an employee working off a boatswain's chair inside a riser of a water tower of 80 feet high was not provided with a lifeline. %%
