Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by lodged tree(s): (a) Smith Tract, logging site - Employee(s) were performing logging operations where overhead lodged tree(s) had not been cut down, on or about 8/27/91. Among other methods, feasible and acceptable abatement methods to correct this hazard include: 1. Always cut down any lodged tree that has not fallen to the ground after being partly or wholly separated from its' stump or displaced from its' natural position. 2. Provide training in recognizing safety hazards associated with each employee's work tasks in logging. 3. Ensure that employees are spaced and duties organized such that the actions of one employee will not create hazards for other workers.
