Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by unsecured metal flywheel cover: a) At the job site, 10911 N. 63rd Ave., Temple Terrace, the cover of the flywheel on the Brush Bandit Chipper, Model #4025724 DOJL 727-E, powered by a Rockford gas motor was held together by the upper hinge hook lock only, on or about November 12, 1991. b) At the job site, 10911 N. 63rd Ave., Temple Terrace, the cover of the flywheel on the Brush Bandit Chipper, Model # 424975, Serial Number #800871, powered by a Rockford gas motor was held together at the top hinge by a drill bit, on or about December 12, 1991. Among other methods, one feasible and acceptable abatement methods to correct this hazard it to utilize the proper hood lock pins to secure the flywheel cover. Also the company should institute and enforce daily inspections of this piece of equipment prior to starting up.
