29 CFR 1926.501(b)(1): Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: The employer does not ensure that each employee on a walking/working surface with an unprotected side or edge, which is 6 feet or more above a lower level, is protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. In Section 12, Unit 391: a) On or about May 13, 2015, at least one (1) employee, who applied the flashing around the third-story balcony windows, doors, ceiling and floor, was not protected from falling more than 23-feet to the lower level. b) On or about May 14, 2015, at least one (1) employee, who was applying felt paper and diamond metal lath to the exterior walls of a third-story balcony, was not protected from falling more than 23-feet to the lower level.
