Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazards of being struck by a wire rope winch line during the process of a Cat dozer pulling a drilling rig tractor and trailer to the well head site. The wire rope was defective in that it had numerous places of crushing, broken wires and one broken strand in (1) rope lay and was severely birdcaged at the winch. The rope was attached to the tractor by a knot tied in the better end and pulling against a link of chain which was attached to the tractor by a hook.
