Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of eye and head injury from an accident resulting from riding motor cycle type vehicles without wearing helmets for eye and head protection. a) On or about 12/20/90, employee was riding on employers farm a Honda all terrain vehicle (Serial No. JH3TE1400JK003813) and was not wearing a helmet for head and eye protection and the employer did not have a program in place that required employees to wear helmets and eye protection when riding the motorcycle type vehicles on private property on the employer's farm. Among other methods, one feasible and acceptable method of abatement to correct this hazard is to require employees to wear helmets and eye protection when operating the motorcycle type vehicles on the farm.
