Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 5/15/90, employees were engagede in hydrostatically testing a steel cryogenic tank per ASME Boiler and Pressure Vessel Code, Section VIII, Division I. During this test, employees were exposed to the hazard of being struck by fragments of steel and various other appurtenances attached or affixed to the vessel when it is pressurized to one and one-half times its design pressure and the inspectors (employees) are allowed to make a "close-up" visual inspection of the vessel under test. Among other methods, several feasible and acceptable abatement methods to correct this hazard is to: 1) Lower the test pressure prior to making the "close-up" visual inspection as provided for in the ASME Boiler and Pressure Vessel Code, Section VIII, Division I, "General Requirements" , Standard Hydrostatic Test, Paragraph UG-99(q). 2) Install a vent line at the highest point of the vessel to purge trapped air inside the tank while it is being filled with water as provided for in the ASME Boiler and Pressure Vessel Code, Section VIII, Division I, "General Requirements", Standard Hydrostatic Test, Paragraphs UG-99(i). 3) Install or place baffle or screen barricades around the vessel to contain any parts that may be expelled as a result of tank pressurization. 4) Pipe stopper or plugs designed to close off various inlets and/or outlets on the vessel prior to pressurization shall be positively secured by welding them to the pipe or vessel, or some other device installed to prevent the stoppers or plugs from being expelled from the pipe or vessel being tested, elg., safty catch chains, etc.
