Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that an employee was exposed to struck by hazards while operating a Utility Vehicle from the passenger side seat: (a) On or about 25 March 2015, at the facility located at 4020 Winchester Ave, Kansas City, MO., one employee was exposed to being struck-by and crushed, when he was operating a John Deere "Gator" Utility Vehicle while sitting in the passenger seat of the vehicle. The inability to safely control the moving vehicle from the passenger seat of the vehicle caused him to accidentally drive into a parked truck container trailer, whereby he received life threatening injuries that later resulted in his death. Abatement certification is required for this item; use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
