Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Finish painters were subject to the hazards of being struck by or crushed by transformers being unintentionally discahrged off the open ends of the conveyor on which they are being painted. This conveyor is located in the finish paint booth and designated conveyor G. Feasible and acceptable methods of abatement to correct this hazard is to establish and enforce procedures such as those stipulated by American National Standard B20.1-1984 Safety Standards for Conveyors and Related Equipment paragraphs 5.11.3 and 5.12. Essential elements would include but not be limited to: a) Only trained employees shall be permitted to operate conveyors. Training shall include instructions in operation under normal conditions and emergency situations. b) Personnel working on or near a conveyor shall be instructed as to the location and operation of pertinent stopping devices. c) Routine inspections and preventive and corrective maintenance programs shall be conducted to insure that all safety features and devices are retained and function properly. d) All safety devices shall be arranged to operate in a "fail safe" manner. That is if power failure or failure to the device itself would occur, a hazardous condition must not result.
