Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck: a)On or about July 23, 1997 employee(s) were exposed to the hazard of being struck by a falling tree trunk due to improper open face cuts being made in that no notching was done and no clear retreat path established. One feasible and acceptable abatement method among others, to correct this hazard is to: 1) Follow recommended guidelines for cutting trees and establish unobstructed paths of retreat.
