Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a. The North Work's: The employer allowed and/or required remote control locomotive operators and conductors working in the Transportation Department to work out of sight of each other to deliver railroad cars to the number 2 shipping building on the number 48-2 railroad track. The operator did not maintain visual contact with the conductor while they were trying to couple-up railroad cars that they were delivering inside of the number 2 shipping building to the railroad cars that had been previously delivered. There was limited clearance of 7 1/2 inches between railroad cars and the retaining wall inside the number 2 shipping, which exposed the conductor to the hazards of being caught between the moving railroad cars and the retaining wall of the shipping dock. On February 26, 1992, at approximately 2:00 PM, a conductor, while trying to couple railroad cars inside the number 2 shipping building on the number 48-2 railroad track, was struck-by railroad car number 36435 and was caught between the retaining wall of the shipping dock and the moving railroad cars. Among other methods, one feasible abatement method to correct this hazard is to require the conductor, after opening the over head door and checking inside the number 2 shipping building to make sure the inside area is clear, to return to the outside in full view of the operator before signaling the operator to move the railroad cars or have the operator position himself in the entrance of the number 2 shipping building before moving the locomotive, the remote controls (black box) and the operator can be at a distance of 12 to 15 railroad cars away. At this distance the operator can still control the locomotive.
