Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to emloyees in that employees were exposed to the hazards of the effects and/or asphyxiation caused by N2 in the shortening vats while transferring oil, sampling and/or checking the vat interior: A feasible and useful method of correcting these hazards is to establish and properly implement effective training and rules for employees working in area where N2 is present, with the following elements as a minimum: a) Train operators in the inherent hazards of N2 exposure. b) Train operators in the proper methods of checking oil levels in the vats. c) Train operators in the proper methods and procedures for oil transfer. d) Appropriately mark all man hatches of vats that contain N2. e) Prohibit operators from opening the man hatches of vats containing N2. f) Keep all viewing ports of man hatches clean and clear. g) Keep all viewing port lights in operating condition. h) Establish and enforce vessel entry procedures including purging, venting, sampling, and issuance of entry permits. i) Only properly trained and equipped employee(s) shall enter confined spaces.
