Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of equipment failure, such as crane collapse, tipping, and falling loads: a) On or about May 9, 1986 the weight of load(s) being hoisted by a Grove Hydraulic Crane was not determined and the operator was not notified prior to hoisting. One feasible and acceptable abatement method, among others, is to require the person directing the hoisting operation(s) to ascertain the weight of the load(s) within 10 percent when approaching the crane's rated capacity, and notify the operator.
