Section 5(a)(1) of the Occupational Safety and Heath Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) On or about 9/18/88 employees were exposed to the hazard of riding on an open flat car having an excessive dimension load which was above clearance of structures in the railroad right-of-way. One feasible and acceptable method, among others, to correct this hazard is to inspect excessive dimension loads before being moved and when clearance of structures is extremely close require the train to stop and proceed by the use of hand signals or verbal communication and, in addition, require all employees to ride in an assigned car equipped for transporting personnel.
