29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. (a)Rio Construction Services, LLC @ 16220 WCR 394, Evans, CO 80645: On and before December 15th, 2014, the employer did not ensure employees were instructed in the recognition and avoidance of unsafe conditions while performing maintenance work within Dakota belly dumping trailers. The employer did not effectively instruct employees in the energy control procedures to ensure employees performing maintenance within the Dakota trailer understood the hazards related to the unexpected release of stored energy. On December 15th, 2014, a driver working within the trailer was attempting to dislodge a mechanical block that would not allow the pneumatically controlled belly dumping doors to close. The driver adjusted the mechanical block releasing the doors and exposed the employee to a caught-in-between hazard resulting in fatal crushing injuries. This condition exposed an employee to caught-in-between hazards. Among other methods, one feasible and acceptable means of abatement involves lock out of the doors in accordance with manufacturers specifications and adhering to ANSI/ASSE Z244.1.
