Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazard of death or accidental amputation, in that the employer did not ensure that adequate training and proper procedures were followed per the manufacturers recommendations when operating the Bandit tree chipper machine, to prevent the operator from having any part of his body in the feed mechanism of the machine, as addressed in "ANSI Z133.1 - 1988 Tree Care Operations, Section 3.1.3".
