Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of contact with high voltage overhead engerized electrical conductors without having someone in the immediate area who was familiar with the hazards in line clearance and was familiar with the special techniques involved and capable of rendering assistance should line contact occur: a) Employee working from aerial lift trimming tree limbs in close proximity to overhead 13,000 volt AC electrical lines at 1373 Hainesport, Mt. Laurel Road in Mt. Laurel, NJ during line clearance tree trimming operations on or about 11/22/88. Among other methods, one feasible and acceptable method of abatement is to adhere to ANSI 2133.1 1982 section 4.2.3 which requires a second qualified line clearance tree trimmer, or a qualified line clearance tree trimmer trainee to be located within normal voice communication during line clearance tree trimming operations when the line clearance tree timmer or line clearance tree trimmer trainee must approach closer than 10 feet to a conductor or electrical operation energized in excess of 750 volts.
