Text For Citation: 01 Item/Group: 001 Hazard: EXPLOSION
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about December 30,1985. a) The hazards of fire and smoke while in the cellar at 3085 B. Tremont Avenue, Bronx, N.Y., because of the lack of an enclosed stairway to prevent the spread of fire and smoke from the 1st floor storeroom to the cellar and to prevent the exit stairway from becoming impassable. Among other methods, one feasible and acceptable abatement method to correct these hazards is to: 1) Construct a stairwell wall having at least a 2 hour fire resistance rating with an access door of the same rating to separate the storeroom and 1st floor from the cellar.
