29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c): The employer does not protect each employee in its trench excavation by properly sloping the excavation or by using appropriate protective systems designed in accordance with paragraphs (b) or (c) of 29 CFR 1926.652. a) This violation was most recently observed on or about July 24, 2019, at 60 Brentwood Dr., Glencoe, Illinois. Employees were not protected from the hazard of cave-in while working in a trench excavation measuring approximately 7.6 feet in depth. Goose Lake Construction Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1317957, citation number 2, item number 1 and was affirmed as a final order on November 19, 2018, with respect to a workplace located at 6001 Capulina Ave., Morton Grove, Illinois 60053. Goose Lake Construction Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1315544, citation number 1, item number 1 and was affirmed as a final order on November 19, 2018, with respect to a workplace located at 921 Pleasant Ln., Glenview, Illinois 60025. Goose Lake Construction Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1162229, citation number 1, item number 3 and was affirmed as a final order on August 15, 2016, with respect to a workplace located at 2515 W Lawrence Ave., Chicago, Illinois 60606. To abate this hazard in the future, the employer must ensure that it's excavations are properly sloped, or that protective systems designed in accordance with this standard are used, and that no employees enter the excavations until protection is provided. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect it's employees from excavation cave-ins
